Heidi works closely with healthcare industry clients assisting them primarily in the areas of:

  • Information Technology (IT) contracting
  • The Health Insurance Portability and Accountability Act (HIPAA)
  • Part 2 Regulations for substance use disorder records
  • State privacy and security issues

Heidi has specialized industry experience in healthcare, including the privacy, security, and breach notification rules of the Health Insurance Portability and Accountability Act (HIPAA) and state laws that affect personal health information, data protection and storage, privacy and security policies, as well as security breaches and identity theft.

Heidi also specializes in information technology issues. As a former partner in a large, international law firm, she led a Health Information Technology Affinity Group, where she was in charge of building a practice that covered transactional matters and privacy and security. She was also a leader of an Electronic Data Management, Privacy, and e-Discovery Group.

Today, because she understands the regulations her clients face, Heidi continues her work on behalf of providers, health insurance companies, and suppliers in the healthcare industry, drafting and negotiating agreements that comply with the requirements of HIPAA and assisting clients in their compliance efforts, including developing policies and procedures and providing regulatory advice on matters.

Heidi is also experienced in technology transactions, and negotiates software licenses, cloud computing and other Software as a Service (SaaS) agreements and similar types of arrangements. She also offers advice on “big data” strategies and provides valued advice for clients as they assess the risks of various cutting-edge technologies.

Representative Matters

  • Advises a non-profit organization in the rollout of a national system of outpatient mental health clinics, including HIPAA matters, state law issues, grant contracting, electronic health record, data warehouse, and other vendor contracting agreements.
  • Advises health information exchanges on contracting matters, appropriate uses and disclosures of health information, vendor contracting matters, and HIPAA and state law compliance.
  • Advises a national association of health plans in its vendor contracting, cloud strategy, and big data strategy.
  • Serves as primary outside counsel for a large health plan in its privacy compliance, including contracting matters, appropriate uses and disclosures under HIPAA, state law issue privacy issues, and security breach risk assessment and notification.
  • Assisted a multi-state hospital system in its implementation of a system-wide clinical and financial information technology system, including vendor contracting and various privacy and security compliance matters.
