Melissa (Mel) Soliz is a partner at Coppersmith Brockelman, PLC, where she leads the firm’s data interoperability and technology practice. Her work focuses on the intersection of law, system design, and real-world data exchange, helping clients translate complex regulatory requirements into functioning data-sharing systems. Mel advises on federal and state data privacy and interoperability laws, including HIPAA, 42 USC 290dd-2 and 42 CFR Part 2, the 21st Century Cures Act (including the ONC Information Blocking Rule, CMS interoperability mandates, and ONC Certification Program), health information networks and exchanges (TEFCA, Carequality, CommonWell, and DURSA), artificial intelligence (AI), and state health and consumer data privacy laws.
Mel has deep experience working with health care providers, payers, and technology companies on data strategy and compliance, as well as the design and implementation of complex data-sharing platforms, including behavioral health and community information exchange. Her practice also includes health IT contracting, AI development and implementation, network audits and investigations, data breaches and regulatory inquiries, and clinical research compliance and contracting. Mel is particularly focused on where interoperability breaks down in practice, whether due to system design, data access disputes, or misalignment across overlapping legal regimes. She helps clients not only comply with evolving requirements but also operationalize and defend their data-sharing strategies in real-world environments.
She is a frequent speaker at national and local forums and is active in state and federal policy discussions on data privacy and health information exchange. Mel serves as President of the Arizona Society of Healthcare Attorneys (AzSHA) and Co-Chair of The Sequoia Project Privacy & Consent Workgroup. She is recognized by Chambers USA, Best Lawyers©, and Super Lawyers, and was named a 2025 Arizona Capitol Times Women Achievers and a 2025 AzBusiness Emerging Leader in Arizona Law.
Representative Matters
- Designed and operationalized data-sharing platforms for technology companies, data analytics firms, and health care organizations, including value-based care solutions, AI-enabled tools, TEFCA/Carequality integrations, patient matching and scheduling platforms, EMRs/patient portals, telehealth solutions, health information networks/exchanges (HIN/HIEs) and community information exchanges (CIEs), and research repositories, aligning legal requirements with technical architecture and product design.
- Led enterprise-wide compliance programs for interoperability regulations, including the ONC Information Blocking Rule and CMS interoperability mandates, by assessing data access practices, developing policies and procedures aligned with regulatory exceptions, restructuring contracts, and training executive and operational teams.
- Advised digital health and consumer-facing technology companies on structuring data strategies and products that enable individual access, integrate social determinants of health data, support care coordination, and advance research, while navigating overlapping federal and state privacy regimes.
- Built and modernized 42 USC 290dd-2 and 42 CFR Part 2 compliance frameworks for health systems, hospitals, and health plans, including data segmentation strategies, consent models, vendor contracting, and workforce training.
- Guided clients through interoperability audits, investigations, and network participation reviews, including under TEFCA, Carequality, and other national and regional exchange frameworks, with a focus on aligning real-world practices with network and regulatory requirements.
- Represented providers, HIN/HIEs, and technology companies in information blocking disputes, data access conflicts, and regulatory investigations, including OCR matters and breach response.
- Negotiated complex, high-value technology transactions, including multimillion-dollar SaaS agreements for health information organizations and technology companies.
- Advised on national health data initiatives, including support for the FDA’s Sentinel Initiative, a distributed network for monitoring medical product safety.
