Austin focuses his practice on election and public law, commercial litigation, and pro bono work with an emphasis on criminal justice issues. He is an experienced litigator and a trusted advisor to clients on a wide range of matters.

In his election and public law practice, Austin represents government officials and agencies in high-profile cases in trial and appellate courts. His experience includes litigation involving civil rights claims, public records disputes, and constitutional issues. Austin also advises candidates, political action committees, nonprofit organizations, and ballot measure sponsors and opponents on legal issues involving elections, campaign finance, and ballot access.

In his commercial litigation practice, Austin advises corporate and individual clients in business and employment disputes involving, among other things, business torts, restrictive covenants, and contractual issues. He has litigated matters in federal and state courts, representing clients in various industries, including real estate, financial services, and health care.

In his pro bono practice, Austin mainly focuses on criminal justice work. He represents incarcerated individuals asserting constitutional and other claims. He also prepares amicus curiae briefs on significant criminal justice issues in the Arizona Court of Appeals and the Arizona Supreme Court.

Before joining Coppersmith Brockelman, Austin practiced law for several years at a national law firm. He also served as a law clerk to the Honorable Vice Chief Justice John Pelander of the Arizona Supreme Court. In his prior career, Austin worked in the financial services industry at Goldman Sachs.

Representative Matters

  • Represented Arizona for Abortion Access, the political action committee that sponsored the Arizona Abortion Access Act (Prop. 139). Austin helped draft the initiative, navigated ballot access complexities, and successfully defended a pre-election challenge to the Arizona Abortion Access Act in court.
  • Represented the State of Arizona, the Arizona Governor, the Arizona Board of Regents, the City of Flagstaff, and other state agencies and local governments in various matters.
  • Successfully defended the campaigns for Arizona Governor Katie Hobbs and Arizona Attorney General Kris Mayes in election contests that sought to undermine the results and integrity of the 2022 General Election.
  • Successfully represented mortgage servicing businesses in several federal and state lawsuits involving defaults on loan obligations. See, e.g., Jahn v. Caliber Home Loans, Inc., No. 19-17198, 840 F. App’x 975 (9th Cir. 2021); Hanks v. Harper, No. 19-17537, 2021 WL 4811374 (9th Cir. 2021).
  • Counsel for amici curiae in support of a statutory and constitutional challenge to the forced sale of condominium units by condominium associations. Cao v. PFP Dorsey Investments, LLC, 257 Ariz. 109, 545 P.3d 459 (2024).
  • Counsel for the Arizona Board of Regents in a lawsuit challenging a lease under ABOR’s statutory leasing power and the Arizona Constitution’s Gift Clause. State v. Arizona Board of Regents, 253 Ariz. 6, 507 P.3d 500 (2022).
  • Counsel for amici curiae in support of a challenge to various budget reconciliation bills under the Arizona Constitution’s title requirement and single subject rule. Arizona School Boards Association, Inc., et al. v. State of Arizona, 252 Ariz. 219, 501 P.3d 731 (2022).
  • Counsel for amicus curiae in support of a criminal defendant who sought to disqualify the Tucson Section of the Arizona Attorney General’s Office because of an appearance of impropriety. State v. Marner, 251 Ariz. 198, 487 P.3d 631 (2021).
  • Counsel for the Arizona Board of Regents in a lawsuit challenging ABOR’s tuition-setting policies. State ex rel. Brnovich v. Arizona Board of Regents, 250 Ariz. 127, 476 P.3d 307 (2020).
  • Counsel for amici curiae in support of a political action committee that sought to place a statewide initiative measure on the ballot and that faced a pre-election challenge to the description of the initiative’s principal provisions printed on petition sheets. Molera v. Hobbs, 250 Ariz. 13, 474 P.3d 667 (2020).
  • Counsel for Abelardo Chaparro in a lawsuit challenging the Director of the Arizona Department of Corrections, Rehabilitation & Reentry’s refusal to certify Mr. Chaparro as eligible for parole. Mr. Chaparro was ultimately released from prison on parole. Chaparro v. Shinn, 248 Ariz. 138, 459 P.3d 50 (2020).
  • Successfully defended a private corporation that contracted with Maricopa County to provide election services in public records litigation. We The People Arizona Alliance v. Runbeck Election Services Inc., et al. (Maricopa County Superior Court Case No. CV2023-051714) (no appeal filed).
  • Successfully represented an incarcerated individual in litigation against the Director of the Arizona Department of Corrections, Rehabilitation & Reentry and secured the client’s release from prison. Gregory Schmidt v. Ryan Thornell (Maricopa County Superior Court Case No. CV2024-009369) (no appeal filed).
