As multilevel marketing companies continue to expand nationwide, Partners Marvin Ruth and Shelley Tolman shared important legal considerations to keep top of mind in an article for In Business’s April issue.

Shelley and Marvin note that the laws and standards governing the multilevel marketing industry are constantly evolving, and that companies should be aware of potential roadblocks that could cause legal issues. They then outlined three tips to help multilevel marketing businesses ensure they are compliant, including keeping records of retail sales by distributors, drawing a clear line between customers and distributors, and monitoring the accuracy of marketing and income statements.

A complex commercial litigator, Shelley has experience in contract disputes, business torts, intellectual property disputes, injunctive proceedings, and class actions. She also has experience litigating government contract disputes involving kickbacks, overbilling, fraud, and the False Claims Act.

Marvin has substantial experience representing clients in complex commercial litigation in state and federal courts in Arizona and Nevada. He primarily focuses on business disputes and litigation, including partnership disputes, real estate litigation, business torts, and fraud claims.
