A health care law veteran, David Bixby draws on a wealth of experience in corporate, regulatory, and transactional legal work to provide health care organizations with strategic guidance. He counsels clients in matters ranging from mergers and acquisitions, joint ventures and affiliations, corporate governance, conflicts of interest and director independence issues, physician and network arrangements, and Stark and anti-kickback matters.

As Banner Health’s Chief Legal Officer for 25 years, David oversaw Banner’s legal affairs as it grew to a $12 billion multi-state integrated healthcare system. He played an active role in organizational policy decision making and chaired the Administrative Policy Committee that developed, reviewed, and standardized system and regional non-clinical policies.

Before joining Banner Health, David was a partner at a regional law firm, representing health care systems in financing and the formation of a regional multi-hospital system and holding company.

Representative Matters

  • Oversaw legal affairs for Banner Health (32 hospitals, 53,000 employees, 2,400 employed physicians and advance practice providers, three Medicare Advantage health plans, an AHCCCS Medicaid plan, a commercial health insurance joint venture, an ambulatory surgery center joint venture and a clinical laboratory joint venture).
  • Managed multiple acquisition transactions, including physician practices and other businesses.
  • Structured the Banner Medical Group and Banner–University Medical Group.
  • Provided oversight of company defense in government investigations and False Claims Act/Qui Tam lawsuits.
  • Managed divestiture of facilities in three states, as well as negotiations and litigation with state attorneys general.
