Melissa (Mel) Soliz is a partner with Coppersmith Brockelman, PLC in Phoenix, Arizona. She leads the Firm’s data interoperability and technology practice where the focus is on advising companies on the intersection of technology and data privacy, security and interoperability. Mel provides practical, real world solutions to challenges involving HIPAA, 42 USC 290dd-2 and 42 CFR Part 2 (Part 2), the 21st Century Cures Act (e.g., the ASTP/ONC Information Blocking Rule, CMS interoperability mandates and ASTP/ONC Certification Program), health information networks/exchanges (HIN/HIEs) (including TEFCA, Carequality, CommonWell and DURSA), artificial intelligence (AI) laws and policies, and state health data and consumer data privacy laws. She has deep experience working with companies on data strategy and compliance, the design and implementation of complex data sharing platforms (including for behavioral health/substance use disorders data and community information exchange), health IT contracting, AI development and implementation, network audits/investigations, data breaches and regulatory investigations, and clinical research compliance/contracting.

Mel regularly speaks in local and national forums on these topics and has been active in state and federal policy making on data privacy and HIN/HIE issues. She is the President of the Arizona Society of Healthcare Attorneys, Co-Chair of the Sequoia Project Privacy & Consent Workgroup, and is recognized by Chambers USA, Best Lawyers©, Super Lawyers and others for her work. She is an Arizona Capitol Times 2025 Women Achievers and AzBusiness Magazine 2025 Emerging Leaders in Arizona Law awardee.

Representative Matters

Worked with cutting-edge technology companies and data analytics companies to offer a variety of technology solutions and data analytic projects in the health care space (g., value-based care data sharing platforms, artificial intelligence (AI) tools, TEFCA/Carequality connections, patient/provider matching and scheduling platforms, EMRs/patient portals, telehealth solutions, community information exchanges, clinical health information exchanges, research repositories, etc.) in compliance with data privacy and interoperability laws.
Worked with health data utilities, private HIN/HIEs, technology companies, health care providers and health plans to create programs for compliance with the ASTP/ONC Information Blocking Rule and the CMS interoperability mandates, including evaluating/assessing practices, crafting information blocking policies and procedures to satisfy safe harbor requirements, revising contracts, updating/creating supporting forms, and providing workforce and community education/training sessions.
Advised consumer-facing technology companies who partner with health plans and health care providers on structuring innovation solutions for advancing individual access services, collecting and integrating social determinants of health data, facilitating care coordination, and research.
Advised multiple health systems, hospitals, and health plans on establishing and/or updating their 42 USC 290dd-2 and 42 CFR Part 2 compliance program, including crafting Part 2 data use policies and procedures, consent forms, drafting/negotiating contracts with vendors, and giving informational presentations/training sessions on Part 2 compliance.
Guided technology companies through vetting and compliance audits and investigations regarding their participation in data exchange under various national, regional, state and private data exchange frameworks, including Carequality and TEFCA.
Drafted and negotiated multimillion-dollar SaaS agreements for health information organizations and technology companies.
Assisted health care providers, HIN/HIOs and technology companies in responding to allegations of information blocking as well as data breaches and OCR investigations.
Assisted in advising the Food and Drug Administration on its Sentinel Initiative, a national electronic distributed network to monitor product safety.
